Terms and Conditions of Sale (TCS)

1. Purpose

These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relations between Béalia (hereinafter "the Seller") and any natural or legal person (hereinafter "the Client") wishing to make a purchase via the website https://béalia.fr

Any order placed on the website implies full and unreserved acceptance of these GTC. The Seller reserves the right to modify the GTC at any time; the applicable GTC are those in force on the date of the order.

3. Products

The Seller offers for sale portable white noise machines for babies and young children, as well as any associated accessories presented on the website.

The essential characteristics of the products are described on each product page. The photographs illustrating the products are provided for information purposes only and are not contractual. The Seller cannot be held responsible for any errors or omissions in these descriptions.

4. Price

Prices are indicated in euros (€), all taxes included (TTC), in accordance with current French legislation. The Seller reserves the right to modify its prices at any time, it being understood that the applicable price is that in force at the time of order validation.

Delivery costs are indicated separately during the ordering process and are borne by the Client, unless otherwise specified (e.g., free delivery from a certain purchase amount). The total amount, including delivery costs, is summarized before final order validation.

5. Order

The Client places an order by following these steps:

  1. Selection of products and addition to cart.
  2. Checking the contents of the cart.
  3. Entering delivery and billing information.
  4. Choosing the delivery method.
  5. Choosing the payment method and validating the payment.
  6. Order confirmation by email.

The order is deemed final after payment confirmation. The Seller reserves the right to refuse or cancel any order in the event of a dispute relating to the payment of a previous order, suspicion of fraud, insufficient stock, or any other legitimate reason. The Client will be informed as soon as possible.

6. Payment

Purchases can be paid for using the following methods:

  • Credit card (Visa, Mastercard, American Express)
  • Shop Pay

Payment is secured by an SSL encryption system. The Client's bank details are not stored by the Seller. The transaction is processed by a certified payment provider.

The debit is made at the time of order validation. In case of payment refusal by the banking institution, the order is automatically cancelled.

7. Delivery

Products are delivered to the address indicated by the Client during the order. The Seller delivers in metropolitan France as well as in the following countries: European Union.

Estimated delivery times are indicated on the product page and during the order process. These times run from the shipping confirmation. They are given as an indication and do not constitute a firm commitment.

In case of delivery delay attributable to the carrier, the Seller cannot be held responsible. The Client is invited to contact customer service at support@bealia.fr for any follow-up or claim.

In case of a lost or damaged package, the Client must report the problem as soon as possible so that a solution can be provided (product re-shipment or refund).

8. Right of Withdrawal

In accordance with articles L.221-18 et seq. of the Consumer Code, the Client has a period of 30 calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay penalties.

To exercise this right, the Client must notify their decision to withdraw to the Seller by email at support@bealia.fr or via the withdrawal form available [link or mention]. The Client must return the product in its original packaging, in perfect condition, to the following address: [return address].

Return costs are borne by the Client, unless the Seller agrees to cover them. The refund will be made within 14 days from receipt of the returned product or proof of shipment, using the same payment method as that used during the order.

The right of withdrawal does not apply to unsealed or used products that cannot be returned for reasons of hygiene or health protection.

9. Returns and Refunds

All returns must be subject to a prior request to customer service at support@bealia.fr. The product must be returned in its original condition, complete (accessories, instructions, packaging), unused and undamaged.

After receipt and verification of the returned product, the Seller will process the refund within a maximum of 14 days. The refund will be made by the same payment method as that used during the purchase, unless otherwise agreed.

Any product returned incomplete, damaged or damaged by the Client will not be refunded or will be subject to a markdown.

10. Guarantees

Legal guarantee of conformity

In accordance with articles L.217-4 et seq. of the Consumer Code, the Seller is obliged to deliver goods that conform to the contract and is responsible for defects in conformity existing at the time of delivery. The Client has a period of 2 years from the delivery of the goods to take action.

Guarantee against hidden defects

In accordance with articles 1641 et seq. of the Civil Code, the Seller is bound by the guarantee for hidden defects in the sold product that render it unfit for its intended use. The Client can choose between canceling the sale or a reduction in the sale price.

11. Liability

The Seller cannot be held responsible for indirect damages resulting from the use of the products sold. The Seller's liability is limited to the amount of the order concerned.

The Seller cannot be held responsible for delays or non-performance due to cases of force majeure as defined by French case law (natural disasters, strikes, pandemics, etc.).

12. Personal Data

Personal data collected during the order is processed in accordance with current regulations, particularly the General Data Protection Regulation (GDPR – EU Regulation 2016/679).

13. Disputes

These GTC are subject to French law. In the event of a dispute, the Client is invited to contact the Seller's customer service first at support@bealia.fr to find an amicable solution.

Failing an amicable resolution, the Client may resort to consumer mediation in accordance with articles L.611-1 et seq. of the Consumer Code.

In case of mediation failure, French courts will have sole jurisdiction to hear the dispute.

14. Acceptance of the GTC

The Client acknowledges having read these General Terms and Conditions of Sale and expressly accepts them by checking the box provided for this purpose during the order process. This acceptance is deemed to constitute a signature and contractual commitment between the parties.
